This User Agreement ("Agreement", "Terms") is a legal agreement between you and HouGarden.Com Ltd("HouGarden", "we", "us", "our") governing your access to and use of the HouGarden mobile application and our websites (together, the "Services"). How we handle your personal information is described separately in our Privacy Policy, which forms part of these Terms by reference.
Please read this Agreement carefully. By registering for, accessing or using the Services, you agree to be bound by it. If you do not agree, please do not use the Services.
By creating an account, or by accessing or using the Services, you confirm that you have read, understood and agree to be bound by this Agreement and our Privacy Policy. If you use the Services on behalf of an organisation, you represent that you are authorised to bind that organisation.
The Services are intended for users aged 16 and over. You must have the legal capacity to enter into this Agreement. We do not knowingly provide the Services to children.
HouGarden is a property information platform for New Zealand and Australia, available in multiple languages. We provide property data, search and related tools. HouGarden does not buy, sell, lease or rent property, and is not a real estate agent, valuer, or financial or legal adviser. Property estimates, valuations (AVM), market metrics and other data are provided for general information only and may be inaccurate or incomplete; they are not professional advice and must not be relied on as the sole basis for any transaction. You should obtain independent professional advice before making decisions.
We may add, change or remove features at any time. Unless stated otherwise, new features are subject to this Agreement.
To use certain features you must register an account and provide accurate, current and complete information, and keep it up to date. You are responsible for safeguarding your password and for all activity under your account. Notify us promptly of any unauthorised use or security issue. We may suspend or terminate accounts that contain information we reasonably believe to be false, outdated or incomplete.
We may use your phone number for registration/login, verification, password recovery, fraud prevention, customer service and important service notifications. Marketing messages are sent only with your separate consent and can be turned off at any time. See the Privacy Policy for details.
You agree not to use the Services to upload, post, transmit or otherwise make available content or conduct that:
You are solely responsible for the content you submit and for activity under your account.
You retain ownership of content you submit. By posting content in any public area of the Services, you grant HouGarden a non-exclusive, royalty-free, worldwide licence to host, store, reproduce, modify (for formatting/display), publish and distribute that content for the purpose of operating and promoting the Services. You are responsible for any claim arising from content you submit. We may, but are not obliged to, review or remove content that we reasonably believe breaches this Agreement.
You may not copy, sell or commercially exploit content posted by other users or other content of the Services without authorisation.
The Services, including software, design, text, graphics and data compilations (excluding user content and third-party materials), are owned by or licensed to HouGarden and are protected by intellectual property laws. Except for the limited right to use the Services under this Agreement, no rights are granted to you.
The Services integrate third-party software development kits (SDKs) and services to provide features such as analytics, crash diagnostics, sign-in, maps, push notifications, live audio/video and file storage. A current directory of these third parties — including their purpose, the categories of data they process, and links to their privacy policies — is set out in Appendix A (Third-Party SDK Directory). Your use of features powered by third parties may also be subject to those third parties' own terms and privacy policies. We are not responsible for the practices of third parties; please review their terms.
The Services may also contain links to third-party websites or resources, which we do not control and for which we are not responsible.
Your use of the Services is also governed by our Privacy Policy, which explains what personal information we collect, how we use and share it, how we keep it secure, and your rights, including how to delete your account and data.
To the maximum extent permitted by law, the Services and all content are provided on an "as is" and "as available" basis. We do not warrant that the Services will be uninterrupted, error-free or secure, or that any data (including property estimates) is accurate, complete or current. Nothing in this Agreement excludes, restricts or modifies any guarantee, right or remedy that cannot lawfully be excluded, including under the New Zealand Consumer Guarantees Act 1993 or the Australian Consumer Law where they apply.
To the maximum extent permitted by law, HouGarden and its affiliates will not be liable for any indirect, incidental, special, consequential or punitive loss, or for any loss of profits, data or goodwill, arising out of or relating to your use of the Services. Where liability cannot be excluded but can be limited, our total liability is limited to the amount you paid us (if any) for the Services in the 12 months before the event giving rise to the claim.
You agree to indemnify HouGarden and its affiliates against claims, losses and reasonable costs arising from your breach of this Agreement, your content, or your misuse of the Services, except to the extent caused by us.
You may stop using the Services at any time and may delete your account as described in the Privacy Policy. We may suspend or terminate your access if you breach this Agreement or applicable law, or to protect the Services or other users. Provisions that by their nature should survive termination (for example Sections 7, 8, 11–13 and 17) will survive.
We may revise this Agreement from time to time. When we do, we will post the updated version and update the "Last updated" date above; for significant changes we will give more prominent notice. Continued use after changes take effect means you accept the revised Agreement. If you do not agree, you should stop using the Services.
This Agreement is governed by the laws of New Zealand. The parties will first attempt to resolve any dispute in good faith. Failing resolution, disputes will be referred to arbitration in Auckland, New Zealand, and the arbitral award will be final, except that either party may seek interim or injunctive relief from a court. Nothing limits your statutory rights as a consumer. If any provision is found invalid, the remaining provisions continue in effect.
We may give notice via email, in-app or website announcement, or other reasonable means. Notices to us should be sent to the contact details below.
